Bedrüddîn İbn Cemâa'nın "El-i'lâm Bi Ehâdîsi'l-Ahkâm" isimli eserinin tahkiki

Abstract

Tahkikini yaptığımız bu çalışma, hadis ilmi ile fıkıh ilmi arasında bir saha olan ahkâm hadislerine dairdir. İlim tarihimizin meşhur simalarından Kadı'l-Kudât Bedreddîn b. Cemâa'ya (ö. 733/1333) ait olan eserin ihtiva ettiği hadisler, Buhârî ve Müslim'in sahihlerinden veya en azından birinden seçilmiştir. Müellif, konu başlıkları itibariyle ana çerçeve olarak Şafiî mezhebinin temel kaynaklarından Ebu İshak eş-Şîrâzî'nin et-Tenbîh'ini esas almıştır. Çalışmamız, İbn Cemâa zamanında yazılmış olan iki nüshaya dayanmaktadır. Bu nüshalar, Süleymaniye Kütüphanesi ve Princeton Üniversitesi Kütüphanesi'nde mevcuttur. Süleymaniye Kütüphanesi nüshasının tahkikteki işareti س, Princeton Kütüphanesininki ise ب olarak gösterilmiştir. Çalışmamız, önsöz, giriş ve üç ana bölümden oluşmaktadır. Önsözde eseri tahkik etmekteki gayemize ve çalışma hakkındaki önemli noktalara dikkat çekilmiştir. Girişte İbn Cemâa'nın hayatı ve eserleri tetkik edilmiş, sonuçta onun kadılık, müderrislik ve hatiplik görevleri yanında İslamî ilimlere ait hemen her alanda eser yazdığı ve tabii olarak pek çok talebe yetiştirdiği gösterilmiştir. Birinci bölümde ahkâm hadisleriyle alakalı çalışmalar hakkında ana hatlarıyla bilgi verilmiş ve İbn Cemâa'nın eserinin metodu ve diğer ahkâm hadislerine dair yapılan çalışmalar içerisindeki konumu mukayeseli bir şekilde ele alınmıştır. İkinci bölümde ise gerek tahkikte gerekse hadislerin tahricinde takip edilen metot ortaya konulmuştur. Ayrıca eserin, İbn Cemâa'ya nispetinin sihhati üzerinde durulmuş, müellife aidiyeti tespit edilmiştir. Diğer taraftan yazma nüshaların tanıtımı ile nüshaların bazı kesitlerinin resimleri ikinci bölüme eklenmiştir. Üçüncü bölümde ise eserin gövdesini oluşturan 15 ana konu ve 769 hadisten meydana gelen metinin tahkiki yer almaktadır. Burada yöntem olarak İslam Araştırmaları Merkezi (İSAM)'nin belirlemiş olduğu tahkik metodunu takip etmiş bulunmaktayız. Çalışmamız âyet, hadis, şahıs indeksleri ve bibliyografya ile sona ermektedir.

Penned by a giant of the Islamic intellectual tradition - Qāḍī al-Quḍā' Badr al-Dīn Ibn Jamā'a (d. 733/1333) - the text presented below compiles legal hadith that lie at the intersection of the Sunni hadith and jurisprudential sciences. The work consists solely of hadith found in one or both of the canonical collections of Bukhārī and Muslim, and its structure and organization take example from al-Tanbīh of Abū Isḥāq al-Shirāzī, itself a core text of the Shāfī'ī madhhab. Thus the text is firmly positioned at the nexus point of two central corpuses of the Sunni intellectual tradition, yet has received little attention to date. The below thesis presents for the first time a critical edition of this important work of Sunni legal thought. The critical edition is derived from two extant manuscripts, both produced during Ibn Jamā'a's lifetime. These manuscripts are held by Süleymaniyye Library and Princeton University Library respectively. In the citation of these source texts, the former is abbreviated as (س) while the latter is referenced as (ب). The project itself consists of a preface, introduction, and three main parts. The preface discusses the motivations behind the editing of this particular text and covers several other critical points of the project. The introduction, examining Ibn Jamā'a's life and works, demonstrates how in addition to excelling in his roles as judge, teacher and preacher, Ibn Jamā'a was able to publish texts and raise students in virtually every branch of the Islamic sciences, demonstrating a unique breadth of knowledge and expertise. Part 1 provides general information on other texts in the Islamic intellectual tradition which focused on legal hadith. It also identifies Ibn Jamā'a's methodology in compiling his own text and comparatively analyzes its place in the wider corpus of works on legal hadith. Part 2 describes the methodologies used in the critical editing of his text and in the analysis of the transmission of the various hadith he includes. Part 2 also analyzes the veracity of the extant manuscripts, and ultimately concludes that these manuscripts are valid copies of Ibn Jamā'a's original text and can be accurately attributed to him in their entirety. Additionally, Part 2 introduces the source manuscripts used in producing a critical edition of the text and provides several images of excerpts taken from these manuscripts. Part 3 presents the critical edition of the text, consisting of 15 main headings and 769 hadith. This section takes as an example the editing methodology outlined by the Islam Research Center (İSAM). The work concludes with indices of Qur'anic verses, hadith and key figures, along with a bibliography.
