Barolar ve Türkiye Barolar Birliğinin örgütlenme modeli ve yeniden yapılanması

Abstract

Baroların ve Barolar Birliğinin amacına uygun, işlevsel ve demokratik bir yapıya kavuşmasını sağlamak için baroların ve barolar birliğinin yeniden yapılandırılmasına ihtiyaç vardır. Meslek onuruna yaraşır, eşit ve hakkaniyetli bir temsil içeren, baroların olmazsa olmazı olan bağımsızlık ve özerklik vasıflarını sağlayan yeni bir yapılanma gereklidir. Barolar; Genel kurul, yönetim kurulu, baro başkanlığı, baro başkanlık divanı, disiplin ve denetleme kurulları gibi organlardan oluşmaktadır. Yapılacak olan düzenleme ile temsilde adaletin sağlandığı, bütün renklerin temsil edildiği baro meclisinin kurulması, baro meclisi tarafından baro başkanı ve yönetiminin denetlemesinin yapılacağı bir yapının oluşturulması bilinen sorunların çözümünde en pratik ve katılımcı yol olacaktır. Türkiye Barolar Birliği de aynı şekilde bir meclise sahip olmalı, başkan ve yönetim kurulu bu meclis tarafından seçilmelidir. Böylelikle barolar ve Türkiye Barolar Birliğinin yapısında demokratik katılım sağlanmış olacaktır.In order to ensure that the Bar Associations and The Union of Turkish Bar Associations have a functional and democratic structure suitable for their purpose, there is a need to restructure the bar associations. A new structuring which provides the characteristics of professional dignity, an equal and equitable representation, which is the sine qua non of the bar associations is required,.A bar consist of bodies such as general assembly, the board of directors, the chair (president), presidency council, discipline and supervisory boards. With the regulation to be made, a bar council (parliement) shall be founded. Bar counsil shall be a platform where fairness is provided in representation and all colors are represented. Establishment of a structure that the bar council chairman and the administration will be supervised by the bar council will be the most practical and participatory way to solve the current problems. Likewise, the Union of Turkish Bar Associations should have a council, president and board of directors should be elected by the parliament. Thus, democratic participation will be provided in the structure of Bar Associations and The Union of Turkish Bar Associations.
