Pîrîzâde'nin 'Umdetü zevi'l-basâir li-halli mühimmâti'l-eşbâh ve'n-nezâir adlı eserinin tahkik ve tahlili

Abstract

Bu çalışmanın konusunu fıkhın alt disiplinlerinden olan kavâid edebiyatı alanında Zeynüddîn İbn Nüceym'in (ö. 970/1563) telif etttiği el-Eşbâh ve'n-nezâir adlı eserine Pîrîzâde İbrahim'in (ö. 1099/1688) 'Umdetü zevî'l-basâir li-halli mühimmâti'l-Eşbâh ve'n-nezâir adıyla yaptığı haşiyenin tahkik ve tahlili oluşturmaktadır. Eserin tahkikinde sekiz nüsha karşılaştırması yapılmış, tahlil kısmında ise Pîrîzâde'nin haşiyesini telif etme gerekçelerinden hareketle eserin tahlili tamamlanmıştır. Ayrıca İbn Nüceym'in el-Eşbâh ve'n-nezâir eseri üzerine yapılan çalışmaların tespitinde daha çok yazma nüshalardan istifade edilmiştir. Araştırmada kavaid edebiyatında eşbâh ve nezâir türünün oluşumunun gerekçeleri üzerinde durulmuş, eşbâh ve nezâir kavramlarının analizleri ve bu sahada telif edilen eserlerin karşılaştırılması yapılmıştır. Eserin tahlili kısmında Pîrîzâde'nin, İbn Nüceym'in el-Eşbâh'ındaki kapalı ifadeleri açıkladığını, Hanefî mezhebi kaynaklarında göremediği bazı meseleleri tespit ettiğini, Hanefî mezhebinin muteber fıkıh ve fetvâ kitaplarında yer alan fakîhlerin görüşlerini esas aldığını, ihtilaflı konularda farklı görüşlere yer vererek müftâ-bih görüşü belirttiğini, sahih/esah olan rivayetleri zikrettikten sonra tercihini ortaya koyduğunu, mütekaddimîn ile müteaahhirîn fakîhlerinin görüşlerine yer verip mu'temet ve râcih görüşleri tercih ettiğini, meşayıhın bazı rivayetlerini zamana uygun bulmadığını belirttiğini, mefhumu rivayet ile amel ettiğini, yeri geldikçe diğer mezheplerin görüşlerine yer verdiğini tespit ettik.

The subject of this study consists of the critical edition and analysis of Pîrîzâde Ibrâhîm's (d. 1099/1688) Umdat dhawî al-basâ'ir li-hall muhimmât al-Ashbâh wa al-nazâ'ir, a commentary (hâshiya) he penned on Zayn al-Din Ibn Nujaym's (d. 970/1563) al-Ashbâh wa al-nazâ'ir, a work written in the field of the qawâ'id literature, a sub-genre of Islamic Jurisprudence (fiqh). The critical text is established based on eight manuscript copies of the work. The analysis of the work follows a method derived from Pirizade's own explanation of the reasons for the composition of the work. In identification of other commentaries that have been composed on Ibn Nujaym's al-Ashbâh wa al-nazâ'ir, we have mostly made use of manuscripts. The study also dwells on the reasons for the emergence of the ashbâh and nazâ'ir genre within the qawa'id literature, analyzes the concepts of ashbâh and nazâ'ir, and provides a comparison of the works composed in this field. In the analysis section we have pointed out that Pîrîzâde opens up and explains the ambiguous expressions in Ibn Nujaym's al-Ashbâh, identifies some questions that Ibn Nujaym could note locate in the sources of the Hanafi school, relies on the opinions of the jurist as recorded in the recognized fiqh and fatwâ books of the Hanafi school, specifies the preferable (muftâ-bih) view after mentioning differing opinions in disputed matters; expresses his own choice after mentioning the sahîh/asahh report, prefers the established (mu'tamad) and preferable (râcih) views after recounting the views of the earlier (mutaqaddim) and later (mutaakhir) jurists; states that he finds unfitting to his time some of the reports of the mashaikh, acts according to the sense/meaning of the report (mafhûm al-riwâya), and gives place to the views of other schools when appropriate.
