Eser Sahibinin Eserin Yeniden Satışından Pay Alma Hakkı

Abstract

Yeniden satıştan pay alma hakkı, üçüncü kişiler arasında ticarete konu olan eserin zamanla kazandığı değer artışından eser sahibine tanınmış bir adil pay ödenmesini isteme hakkıdır. Hukuki niteliği itibarıyla mali haklar arasında yer alan bu hak, 5846 sayılı Fikir ve Sanat Eserleri Kanununun (FSEK) 45. maddesinde düzenlenmiştir.Ancak FSEK’in kabul edildiği 1951 yılında eser sahibine tanınmış bir hak olmasına rağmen, bugüne dek bu hakkın, eser sahibinin diğer mali hakları kadar etkin ve yaygın bir uygulaması olmamıştır. Kanunda 2004 yılında 5101 sayılı Yasayla yapılan değişiklikler de beklenen etkinliği sağlayamamıştır.Kültür ve Turizm Bakanlığı’nın insiyatifiyle 2017 yılında FSEK’te değişiklikler yapmayı amaçlayan bir kanun çalışması yapılmış ve hazırlık komisyonu tarafından oluşturulan Taslak ile yeniden satıştan pay alma hakkına ilişkin 45. maddenin de tamamıyla değiştirilmesi öngörülmüştür. Bu suretle hem AB müktesebatına uyumun sağlanması hem de mezkûr hakkın uygulamasında etkinliğin sağlanması hedeflenmektedir.Bu makalenin konusunu eser sahibinin, eserin yeniden satışından uygun bir bedel ve pay alma hakkına ilişkin düzenlemeler oluşturmaktadır. Bu çerçevede önce, bu hakkın temelinde yatan mülahazalara, yabancı ve uluslararası hukuklardaki tarihi gelişimine ve AB müktesebatındaki yerine özetle değinilecektir. Ardından FSEK’in meriyetteki 45. maddesi irdelenecek, son olarak da Kanun Taslağında yer alan madde hükümlerinin değerlendirilmesi yapılacaktır.

The droit de suite, namely resale right, is the right vested to the owner of copyright on works of fine art to receive a fair share of the third person, who gained extra value of the work for which it was commercialized over time. This right, which is among the economic rights of the author of work in legal nature, is regulated in Article 45 of the Turkish Copyright Code (TCC).However, it is the fact that since 1951, when the TCC was accepted in Turkish law, even though it is a recognized right to the work, this right has not been achieved effective and widespread application like other economic rights on copyrighted work. It was seen that the amendments made in the TCC in 2001 did not provide the expected effectiveness in the application of the droit de suite domain.In 2017, the draft law prepared by Ministry of Culture aimed at making additional articles and some amendments to the TCC was undertaken, as well as Article 45 of the TCC on the right to receive shares in the draft text of this work has been completely amended. With the new legal regulation, which is harmonized to the EU acquis, it is expected that the implementation of this right will be effective in Turkey.The subject matter of this essay is to analyze the regulations on the right of copyright owner to receive an equitable share from resale of fine art works. In this context, the underlying considerations of the droit de suite will be summarized in its historical development of the perspectives in foreign and international law, as well as the EU acquis. Following this, existing Article 45 of the TCC will be examined and finally the provisions of the article in the draft law will be evaluated.
