In this study, the legal status of war booty in the Ottoman Empire is examined. The thesis investigates the status under Islamic law of movable property, lands, and captives acquired as booty from the enemy as a result of warfare, as well as the manifestation of these rulings in the practice of the Ottoman Empire. The research adopts a methodology of examining historical events from a legal perspective, based on sources of Islamic law—namely works of fiqh and fatwas—as well as Ottoman chronicles, collections of legal opinions, law codes (kanunnames), and archival documents. It has been determined that the Ottoman Empire's practice concerning war booty (movable property, conquered lands, and war captives) generally conformed to the fundamental principles of Islamic law—particularly those of the Hanafi school—regarding the acquisition, distribution, and tanfil (supererogatory assignment) of booty; the allocation of one-fifth (khums) to the public treasury (bayt al-mal); the legal status of conquered lands; and the legal treatment of captives. Consequently, it is understood that institutions such as plunder (yağma), the pençik system, and state lands (miri land) in the Ottoman Empire were predicated upon the Islamic law of booty.
