Geleneksel tahvillere alternatif olarak sukuk ve çağdaş uygulamaları

Abstract

Bu Çalışma İslami sukuk, onun önemi, doğuşu, İslam hukukuna uygunluk görüşü ve çeşitlerini ortaya koymaktır. Malezya, Birleşik Arap Emirlikleri'nin tecrübelerini dikkate alarak Sukukun iktisadi önemi, ihraç edilen sukuk hacmi tespite çalışılmıştır. Ayrıca Tahvil ve çeşitleri, şeri durumları ve bu hususta ulemanın ve İslam Fıkıh Akademisinin görüşlerini beyan edilmiştir. Çalışmada, sukukun önemli bir yatırım aracı olduğu ve 2008 yılı dünya finans krizinden sonra likidite ve devletlerin genel bütçe açıklarını gidermede etkin bir araç olduğu sonucuna varılmıştır. Lakin sukukun bazı pratik uygulamalarında İslam hukukuna aykırılıklar tespit edilmiştir. Buna rağmen başta ülkenin kalkınması, gelişmesi ve yol, köprü, sağlık, enerji, hastane, okul v. gibi altyapı yatırımlarında Sukuk yönteminin değerlendirilmektedir. Fakat Sukuk ihracı yapan banka, kurum veya şirketlerin, İslam Fıkıh Akademilerinin belirledikleri ilkelere uygun hareket etmeleri ve itfaı dahil Sukuk ihraç süreçlerinin tamamının şeri denetime tabi olması gerekir.

This study aimed to detect the Islamic securities, and its importance, creation, and ideal which adopts with the Islamic sharia rules , also its types , and explain the economic importance of the securities , with showing some of the countries experiments ( malysia , united emarites , Saudi Arabia ) and the exports volume including the securities , also explaining the bonds fact and its types and its legitimate ruling and scientists speech on , and the opinion of Islamic jurisprudence board , and the study concluded that the securities became very important investment tools , especially after occurring the international crisis of year 2008 , since it is an effective tool for saving liquidity and supporting the deficit of general budget of the country , but with practical application for some securities, it is found some legitimate problems accordingly , the researcher recommends to depend on the idea of securities specially for the countries desiring to develop its nation and for more development , progress and infrastructure projects including roads , bridges , and drainage , electricity networks , hospitals and schools ... etc . But the securities issuer including banks or institutions , companies should comply with the rules issued and agreed on by jurisprudence board , also there should be control on all process of securities' issuing up to the process of amortization .
