Abstract

This study "The Provisions of The Guarantee and Insurance and its Modern Issues" aims to identify the concept of sponsorship and guarantee and the importance of their knowledge and influence in the daily life of man, and the extent of man's responsibility for his commitment through his warranty contract, and his commitment to what he says and the importance of sponsorship and guarantee in foreign trade, and local through the letter of guarantee and documentary credit, His life and property, and the importance of documenting rights through the guarantee and guarantee contract for the individual and society, and the importance of this in the development and growth of the Islamic economy. The study included all the issues related to the issue of guarantee, both heritage and contemporary, to mention the issues in detail agreed upon and different in them and to indicate the differences and the most likely to achieve modern texts.

هدفت هذه الدراسة"أحكام الكفالة والضمان وقضاياهما المعاصرة دراسة فقهية مقارنة" إلى التعرف على مفهوم الكفالة والضمان ومدى أهمية معرفتهما وتأثيرهما في حياة الإنسان اليومية ومدى مسؤولية الإنسان عن التزامه من خلال عقده للكفالة والتزامه لما يقوله ومدى أهمية الكفالة والضمان في التجارات الخارجية، والمحلية من خلال خطاب الضمان والاعتماد المستندي، وكذا أهيمه معرفة التأمين على حياته وممتلكاته، ومدى أهمية توثيق الحقوق من خلال عقد الكفالة والضمان بالنسبة للفرد والمجتمع، ومدى أهمية ذلك في تطور ونمو الاقتصاد الإسلامي. وقد احتوت الدراسة على كل المسائل التي تتعلق بموضوع الكفالة سواء التراثية والمعاصرة من ذكر المسائل بالتفصيل المتفق عليها والمختلف فيها وبيان أوجه الاختلاف والمختار مع تحقيق النصوص الحديثية.

Kefalet ve garanti hükümleri ile bunların güncel meselelerini içeren bu tez çalışması, kefalet ve garantinin mefhumuna, insanların günlük hayatta bunları bilmesinin ne denli etki ve önem arz ediyor olmasına dikkat çekmektedir. Ayrıca insanın kefalet akdi yapması durumunda söylediği şeyin onun üzerindeki yaptırımı, garanti ya da kredi dolayısıyla gerçekleşen yerel ve dış ticarette kefalet ve garantinin ehemmiyetini konu almaktadır. Bunların yanı sıra hayat ve mal varlıklarını kapsayan sigortalara ve gerek toplum ve gerekse fertler için yapılan garanti ve kefalet sözleşmelerinde hakların tesbitine ve tüm bunların İslam ekonomisinin kalkınması ve gelişmesinde oynayacağı role ışık tutmaktadır. Kefaletin her çeşidi ile ilintili tüm meselelerin tafsilatlı bir şekilde zikredilmesi, üzerinde ittifak edilen ve kendisinde ihtilafa düşülen hususların ortaya konması ve hadis metinlerinin tahkiki ile doğru olan görüşün saptanması da yine bu tezin ihtiva ettiği bir başka yöndür.
