İslam’da inanç özgürlüğünün hususiyetleri

Abstract

İslam’da inanç özgürlüğü mefhumu, sınırlarıyla beraber çokça tartışılan meselelerdendir. “İslam’da inanç özgürlüğü var mı, varsa sınırları nelerdir, tanınan bu özgürlük inanmayanları da kapsar mı?” gibi birçok soru bu kapsamda sorulmaktadır. Bu makalede de öncelikle kavram olarak inanç hürriyetinin neye karşılık geldiği işlenecektir. Ardından kaynaklarda inanç özgürlüğünün nasıl anlaşıldığı Kur’an ayetleri ve hadisler etrafında anlaşılmaya çalışılacaktır. İlgili başlıklarda konu üzerinde tartışmaya medar olan meseleler ayrı bir başlık altında irdelenecektir. Serdedilen ihtilaflar üzerinden bir sonuca varmaya çalışılacaktır. Ardından İslam Hukukunda inanç hürriyeti başlığı altında, bu hürriyetin boyutlarını ele alınacaktır. Burada daha ziyade hadisenin inanmayanlar, gayrı-müslimler boyutu ele alınacaktır. Onlara verilen haklar ve mükellefiyetler ayrı başlıklar altında incelenerek mezkur sorulara cevaplar aranacaktır. Bu sayede, inanç özgürlüğünün sınırları, kimleri kapsadığı, Müslüman için, Gayrimüslim nasıl anlaşılması gerektiği saptanmaya çalışılacaktır. Ayetler ve hadisler üzerinden şekillenecek makale sadece naslar temele alınarak hazırlanmış ve ihtilaflara da bu minvalde cevaplar aranmaya çalışılmıştır.

The concept of freedom of belief in Islam, along with its borders, is one of the most discussed issues. Many questions can be asked in this context including; "Is there freedom of belief in Islam, if so, what are its limits, who does this freedom encompass?" The first part of the article aims to shed lights on the concept of freedom of belief, its analytical definition, and the traditional debates regarding the interpretation of religious texts on the issue. Then, how the freedom of belief is understood in the textual sources will be analysed to highlight and conceptualise the relevant verses of the Qur'an and the Prophetic narration (ḥadīths). The selected verses and particular ḥadīths will be deeply examined by referring the classical exegesis of the scholars to draw the framework of the freedom. The rulings of Islamic law regarding the freedom of belief, its dimensions and practicality will be discussed to figure out the status of non-Muslims. The analysis will focus on the reflections and dimensions of the non-believers and non-Muslims regarding the freedom of belief. The rights and obligations given to them will be examined to draw the borders of freedom and the external relationship. This deep analysis aims to determine the limits of freedom of belief, who it covers, and how the non-Muslim should be understood for a Muslim. The conclusive part aims to summary and categorise the main approaches among the believers and scholars regarding the freedom of belief. The article by referring the Qur’anic verses and ḥadīths has been prepared on the basis of the textual sources and provides answers to the conflicts regarding the status of non-Muslims.
