Abstract

Bu çalışma tahkimin ne olduğunu tanımlamayı, türlerini bilmeyi, İslam hukukunda meşruiyetini açıklamayı ve danışmanlık, yargı, uzlaşma ve uzlaşma arasındaki farkları ve farklılıkları tespit etmeyi ve tahkim şartlarını bilmeyi ve İslam hukukunda tahkim yerini açıklamayı amaçladı. This study aimed at identifying what is arbitration, knowing its types, explaining its legitimacy in Islamic jurisprudence, and identifying the differences and differences between advisory, judiciary, conciliation, and conciliation, and knowing the terms of arbitration, the arbitrator, and explaining the place of arbitration in Islamic jurisprudence. In this paper, she highlighted the advantages and disadvantages of arbitration. And I clarified the importance of arbitration to countries and its impact on investment, and I have followed a set of scientific methodologies that dealt with the subject, through an inductive approach that aims to extrapolate the reality of the research problem in order to collect the necessary data to identify the characteristics of the research problem, and diagnose various aspects of it, and this through data collection Necessary on the research problem through several sources, the most important of which are previous studies that dealt with the subject of research, desktop information survey, and specialized references in arbitration. I followed the deductive approach to using deduction in the study to extract the results, recommendations and proposed policies regarding the research problem. And it dealt with arbitration in several aspects. It presented aspects of arbitration in terms of legitimacy and legal, so that the study is within an integrated conceptual framework, and the research concluded with a set of recommendations, most notably work to increase coordination between Arab arbitration bodies to come out with an Islamic system that derives value and conditions from Islamic law.
