المشتقات المالية: تطبيقاتها والتحديات التي تواجهها: دراسة ميدانية من وجهة نظر المختصين في الأسواق المالية في المؤسسات المالية الإسلامية

Abstract

Islamic banks have faced many challenges in the fields of investment and treasury in general and in derivatives markets in particular, as a result of the development of Islamic banking in the world of finance and business, and competition with traditional banking in financial markets, as well as the desire of the Bankers to adapt the construction of these financial instruments to make them Sharia compliant. This research aims to highlight on Islamic derivatives contracts in contemporary financial markets in terms of their nature, functions and importance, In addition to the extent to which Islamic derivative contracts are applied and the contemporary challenges facing them in these markets. In order to achieve the objectives of the study, the researchers conducted a questionnaire surveying the opinions of specialists in this field. The study concluded that the view of these people of the importance of applying Islamic derivatives contracts in the financial markets by Islamic banks was medium, and this is due to the lack of great conviction of derivatives regarding of the problems they have and challenges, most notably the Sharia commitment and lack of owning assets and the absence of financial markets in the Arab countries. The study recommended for directing the research and development departments in the Islamic financial industry to provide new Islamic products that are compatible with financial derivatives in the financial markets according to the rules and fundamentals of the Islamic economy. The study also recommended the introduction of clear criteria for financial derivatives in accordance with the Shari'a standards prepared by the Accounting and Auditing Organization for Islamic Financial Institutions (AAOIFI), which will provide a clear mechanism of action for Islamic banks in derivative instruments.

واجهت المصارف الإسلامية تحديات عديدة في مجالات الاستثمار والخزينة عامة وفي أسواق المشتقات المالية خاصة، نتيجة تطور أعمال الصيرفة الإسلامية في عالم المال والأعمال، ومنافستها للصيرفة التقليدية في الأسواق المالية، وكذلك رغبة من المصرفيين في إجراء مواءمة ما في بناء هذه الأدوات المالية لتجعلها مقبولة شرعاً. يهدف هذا البحث إلى إلقاء الضوء على عقود المشتقات المالية الإسلامية في الأسواق المالية المعاصرة من حيث ماهيتها ووظائفها وأهميتها، ومدى تطبيق عقود المشتقات الإسلامية والتحديات المعاصرة التي تواجهها في هذه الأسواق. ولتحقيق أهداف الدراسة نفذ الباحثان استبيانا استطلعت فيه آراء مختصين في هذا المجال، وقد خلصت الدراسة إلى أن رؤية هؤلاء مختصين لأهمية تطبيق عقود المشتقات المالية الإسلامية في الأسواق المالية من قبل المصارف الإسلامية كانت متوسطة وهذا يرجع إلى عدم القناعة الكبيرة بهذه الأدوات في ظل ما يعتريها من إشكالات وتحديات أبرزها الالتزام الشرعي وعدم تملك الأصول وعدم وجود أسواق مالية لتطبيقها في الدول العربية. وقد دعت الدراسة إلى توجيه دوائر البحث والتطوير في الصناعة المالية الإسلامية لتقديم أدوات وصيغ إسلامية جديدة تتواءم مع المشتقات المالية في الأسواق المالية في ضوء قواعد وأصول الاقتصاد الاسلامي. كما أوصت الدراسة بضرورة طرح معايير واضحة للمشتقات المالية أسوة بالمعايير الشرعية التي تقوم بإعدادها هيئة المحاسبة والمراجعة للمؤسسات المالية الإسلامية - أيوفي والتي من شأنها أن تقدم آلية عمل واضحة للمصارف الإسلامية في أدوات المشتقات المالية.
