İslam hukukunda vekâlet akdi ve katılım bankacılığı uygulamaları

Abstract

Bu çalışmamızda İslam hukuku açısından temsil kavramı, vekâlet konusu ve vekâlet akidlerinin katılım bankalarındaki uygulamalarını inceledik. Temsil insanoğlunun geçmişten günümüze kadar her zaman ihtiyaç duyduğu bir müessesedir. Temsilin en yaygın olanı akid türü ise vekâlettir. Ticari ve sosyal hayatımızda temsil kavramı çok yaygın olarak kullanılmakta ve her geçen gün daha da yaygınlaşmaktadır. Vekâlet sözleşmeleri bu temsil akidleri arasında özel bir yeri bulunmaktadır. Finans alanındaki hızlı gelişimlerin etkisiyle, İslami açıdan faaliyet gösteren finansal kurumlar ve bu kurumların hizmete sundukları ürün ve hizmetlerinde de artış görülmektedir. Bu ürün ve hizmetler İslami açıdan değerlendirildiğinde, uygun olmayan ürünler ya kabul görmemekte ya da İslami değerlere uygun hale getirilmeye çalışılmaktadır. Finansman ihtiyaçlarının karşılanması için İslami finans sisteminde ortaya çıkan finansman yöntemlerinden biri de vekâlet sözleşmesidir. Vekâlet sözleşmesinde yatırımcı ücreti karşılığında birini vekil tayin ederken, vekil de daha önceden belirlenen oranda gelir elde etmek için bu sermaye ile ticaret yapar. Tezimizde önce vekâlet kavramı İslam Hukuku ve Pozitif Hukuk alanında geniş olarak ele alınmış, sonrasında katılım bankalarındaki uygulamaları incelenmiştir.

In this study, In this study, we examined the concept of representation in terms of Islamic law, the subject of attorney and the applications of proxy contracts in participation banks. Representation is an institution that human beings have always needed from past to present. The most common type of representation is contractual power. The concept of representation is widely used in our commercial and social life and is becoming more and more widespread day by day. Attorney contracts have a special place among these representation contracts. With the effect of the rapid developments in the field of finance, there is an increase in the financial institutions operating in Islamic terms and the products and services offered by these institutions. When these products and services are evaluated from an Islamic perspective, unsuitable products are either not accepted or attempted to be adapted to Islamic values. One of the financing methods emerging in the Islamic finance system to meet the financing needs is the proxy contract. In the proxy contract, while a proxy is appointed for the investor's fee, the proxy also trades with this capital to earn a predetermined amount of income. In our thesis, first of all, the concept of proxy is dealt with in the field of Islamic Law and Positive Law, and then its applications in participation banks are examined.
