Fikir ve sanat eser sahibinin manevi haklarına tecavüzün ref’i

Abstract

Bir edebiyat ve sanat eserini meydana getiren kimsenin hukuken o eser üzerinde sahip olduğu telif hakları, mali ve manevi boyutu olan yetki ve menfaatlerden oluşur. Manevi haklar eser sahibinin edebi ve sanatsal kişiliğiyle ilgilidir. Mali haklar ise eserden iktisaden yararlanmaya imkân veren yetkileri içerir. FSEK eser sahibine tanınan bu haklardan her ikisini de etkili bir şekilde himayeyi amaçlar. Bu amaçla eser sahibine Kanunun 66-70. maddelerinde çeşitli dava hakları tanınmıştır. Bunlar arasında tecavüzün ref’i davası, hakların himayesi konusunda önemli bir yere sahiptir. Manevi haklara tecavüzün ref’i 67. maddede, mali haklara tecavüzün ref’i ise 68. maddede tanzim olunmuştur. İşbu makalenin konusunu yalnızca 67. maddede düzenlenen eser sahibinin manevi haklarına yönelik tecavüzün ref’i davası oluşturmaktadır. Bu çerçevede makalede ilk önce tecavüzün ref’i kavramına, arkasından bu davanın açılabilmesinin şartlarına, son olarak da manevi haklara tecavüz halinde bunun kaldırılması için başvurulabilecek yöntemlerin neler olduğuna ayrıntılı olarak değinilmektedir.

The copyrights of the person who created a work of literature and art on that work legally consist of powers and interests with financial and moral dimensions. While moral rights are related to the literary and artistic personality of the author, financial rights consist of economic interests on the work. Turkish Copyright Code (TCC/FSEK) aims to effectively protect both of these rights granted to the author. For this purpose, various litigation rights have been granted to the owner of the work in Articles 66 et al. Among these, the action to stop infringement of copyright has an important role in the protection of authors’ moral and financial rights. While Article 67 of TCC provides lawsuit for termination of infringement on the moral rights, Article 68 includes aforementioned lawsuit in terms of economic rights of author. The subject of this article is only the lawsuit for termination of infringement on the moral rights of the author, which is regulated in Article 67 of TCC. In this context, in the article, firstly, the concept of stopping copyright infringement, then the conditions for filing this lawsuit, and finally, the methods that can be applied in case of infringement on moral rights of author are being discussed in detail.
