Abstract

MS 2014 ile 2022 yılları arasında Yemen'de vakıf fonlarının sürdürülmesinde Dokümantasyon ve onay rolünü bilmek; Çalışmada, İslam ve Yemen vakıflarının açıklanması, her birinin aşamalarının sırayla açıklanması, Yemen hukukunda vakıf, belge ve delillerle ilgili mevzuatın tespit edilmesi ve ardından incelenen dönemdeki rolünün sonuçlandırılması amaçlanmıştır. Çalışma aynı zamanda şu hedeflere ulaşmayı amaçlar; Kelime dağarcığının tanımlarının izini sürmek ve bunları özel ve basitleştirilmiş bir şekilde formüle etmek için betimleyici tümevarımsal yaklaşım, genel olarak vakıf tarihinin ve Yemen vakıflarının çoklu aşamalar ve yakın dönemler boyunca izini sürmeye yönelik tarihsel yaklaşım , ardından anket aracılığıyla hedef kitleye ulaşılmış ve onların görüşleri toplanmıştır. Toplanan veriler, istatistiksel yöntemler kullanılarak analiz edilmiş ve sonuçlar sade bir dille betimlenmiştir. Bu sayede, vakıflara ilişkin mevcut veriler göz önünde bulundurularak net bir şekilde ortaya konmuştur. Çalışma, belirtilen dönemde Yemen'deki savaş koşullarında vakıf fonlarının sürdürülmesiyla ilgili olarak Dokümantasyon ve onay arasında güçlü bir ilişki olduğunu ortaya koymuştur. Ayrıca, vakıf kayıtlarının ve belgelerinin korunmasına yönelik önleyici tedbirlerde ve vakıf çalışanları üzerinde denetimde belirgin bir zayıflık olduğu tespit edilmiştir. Savaşın neden olduğu yeni zorluklar vakıf mallarını olumsuz etkilemiş, belge ve delillendirmede ve vakıf belgelerinde eksiklikler ve zayıflıklar ortaya çıkmıştır. Bu olumsuz gelişmelere karşı yetkililerin yetersiz kaldığı da gözlemlenmiştir. Sonuç olarak, çalışma şu önerileri sunmaktadır: Dokümantasyon ve onay yöntemlerinin ilişkin yasaların geliştirilmesi, vakıf fonlarını sürdürülmeye yönelik araştırma projelerinin desteklenmesi, devlet belgelerinin korunması, vakıf kurumunun tarafsızlığının sağlanması, denetleme mekanizmalarının etkinleştirilmesi, savaşın etkilerini incelemek ve Çözümler geliştirip yasalar çıkarması için özel komisyonların kurulması, vakıfların önemi konusunda farkındalığın yayılması.

To understand the role of documentation and verification in the sustainability of endowment funds in Yemen between 2014 and 2022, this study aims to elucidate the Islamic and Yemeni endowment funds, outlining the stages of each, and identify the legislation related to endowment funds, documentation, and verification in Yemeni law. The study employs an inductive-descriptive methodology to define and simplify terminologies, a historical approach to trace the history of endowment funds in general and Yemeni endowment funds in specific through its various stages and periods, and an analytical-statistical approach through a questionnaire to collect and statistically analyze the opinions, simplifying the results while considering the current situation comprehensively. The study concludes a strong correlation between documentation, verification, and the sustainability of endowment funds amidst the war in Yemen during the studied period. It highlights significant deficiencies in the protective procedures of endowment records and documents and also observes an inadequacy in the monitoring of employees working in the sector of endowment funds. This study also finds out that some new challenges arose because of war and affected endowment funds negatively. The war caused the emergence of irregularities in documentation, and verification along with the incapability of the officials to confront all these negative developments. The study recommends the development of laws regarding the documentation and verification methods, support for research projects aimed at promoting documentation and verification for the sustainability of endowment funds and state documents, the neutrality of endowment institutions during wartime, and the activation of their monitoring mechanisms. Additionally, it also suggests the formation of special committees by the state to study the war's effects and propose solutions, to constitute laws along with raising awareness in society about the importance of endowment funds.
