Kocanın bir te’dîb aracı olarak nâşize durumundaki eşini darb etme yetkisi ve idarenin bu yetkiyi sınırlandırması

Abstract

Karı-koca ilişkisinde iyi muamele esastır. Ne şekilde olursa olsun, evlilik bağı devam ettiği sürece iyi muâmele muhafaza edilir. Kocanın te’dîb hakkı, ıslah ve evliliği koruma amacına matuf olduğundan ötürü iyi muâmele esasını zedeleyecek şekilde kullanılamaz. Te’dîb vasıtalarından biri olan darbın şer’î hükmü ne vâcib ne de müstehabtır. Ayrıca bu hüküm, vahyin nüzulü esnasında toplumun mevcut örfüne uygun olarak belli bir maslahata dönük nâzil olan nas ile ortaya konmuştur. Bu bakımdan darbın hükmü, örf ve maslahata göre değişken karaktere sahiptir. Bu nitelikteki şer’î hükümler üzerinde yöneticilerin toplumun yararına olacak şekilde tedbir alma, tasarrufta bulunma yetkisi söz konusudur. Bu çalışmada; Kur'ân-ı Kerim’de bir terbiye aracı olarak geçen darbın hükmünün değişken karaktere sahip oluşu ve idarenin bu hüküm üzerindeki tasarruf yetkisi, Hz. Peygamber’in (as) tatbikatı, makâsıdu’ş-şerîa ve fıkıh müktesebatı ışığında ortaya konulmaya çalışılmıştır.

Good treatment in the relationship between husband and wife is essential. In any case, this is kept as long as the marriage bond continues. The right of edification (te’dîb) for husband, because it is for the purpose of rehabilitation and protecting the marriage it cannot be used in a way that would outrage the principle of good treatment. The legal verdict of the beating (darb), which is one of the tools of Te’dîb, is neither vâcib nor the mustahab. In addition, this verdict, during the arrival of the revelation, in accordance with the existing customs of the society, is revealed with nas coming down for a certain benefit (maslahat). In this respect, the verdict of the beating has a variable character according to custom and benefit. On such as these legal verdicts, managers have the power to take measures and make savings for the benefit of society. In this study; the variable character of the verdict of the beating (darb) which is passing one of the tools of edification (te’dîb) in the Qur'an and the authority of managers on this verdict tried to put forward in the light of the exercise of the Prophet, maqasid al-shariah and the acquisitions of fiqh.
