İfaya Ekli Ceza Koşulunun Varlığı Hâlinde Çekince Beyanı

Abstract

İfaya ekli ceza koşulunun kararlaştırılmış olması hâlinde alacaklı ifanın yanı sıra ceza koşulu olarak kararlaştırılan bedeli de talep edebilir. Alacaklının ifaya ekli ceza koşulu talebinde bulunabilmesi için ceza koşulu talebinden açıkça fera gat etmemiş olmalı ya da yalnızca asıl borcun ifasını çekince beyanında bulun madan kabul etmemiş olmalıdır. Çekince beyanının ileri sürülmemesi halinde ceza koşulu isteme hakkının kaybedilmesi, çekince beyanının niteliğinin külfet olduğunu gösterir. Çekince beyanının ileri sürülebilmesi için, geçerli bir asıl borç olmalı, söz konusu asıl borç belirlenen yer veya zamanda ifa edilmemiş olmalı ve son olarak da bu durum için ifaya ekli ceza koşulunun ödeneceği kararlaştırılmış olmalıdır. Çekince beyanının yapılması şekle tabi değildir. Çekince beyanı en geç ifa anına kadar yapılmalıdır. İfa anı ifadesi katı yorumlanmamalı ifadan makul süre sonra yapılan çekince beyanı da geçerli kabul edilmelidir. Çekince beyanın dan feragat edilebilir. Çekince beyanının ileri sürülmemesi kanuni karine gereği ceza koşulu isteminden örtülü feragat anlamına gelir. Çekince beyanının yapıldı ğını ispat yükü alacaklıdadır

In the case of a penalty clause attached to the performance, the creditor may demand both the performance and the price agreed as a penalty clause. For the creditor to claim a penalty clause attached to the performance, the creditor must’nt have expressly waived the penalty clause claim or only accepted the performance of the principal debt without expressing a reservation. The nature of the reserva tion is an onus. In order to assert a reservation, there must be a valid principal obligation, the principal obligation in question must not have been performed at the specified place or time, and finally, it must have been agreed that a penalty clause attached to the performance will be paid for this situation. The declaration of reservation is not subject to form. The declaration of reservation must be made until the moment of performance at the latest. The term “moment of performance” should not be interpreted strictly. The declaration of reservation may be waived. Failure to assert the declaration of reservation shall constitute an implicit waiver of the claim for penal clause pursuant to the legal presumption. The burden of proof is on the creditor to prove that the declaration of reservation was made.
