أثر الاختلاف في مفهوم العلة وشروطها على الأحكام الفقهية عند الحنفية والشافعية

Abstract

Çalışma, Hanefi ve Şafii mezheplerinde illet kavramı ve şartlarındaki farklılıkların fıkhi hükümler üzerindeki etkisini açıklamayı amaçlamaktadır. Çalışma, tümdengelim, tümevarım ve analitik yöntemlerin her birini kullanarak, iki mezhep arasındaki illet kavramındaki anlaşma ve farklılık noktalarını ortaya koymuştur. Sonuç olarak, iki mezhebin çoğunluğunun illetin bâis değil, muarrif vasıf olarak tanımlanmasında hemfikir olduğunu ortaya koymuştur Çalışmada ayrıca Hanefi mezhebine göre illetin, müessir bir vasıf olarak anlatılması durumunda Şafiilere göre anlamının daha geniş olduğu, illetin münasib bir vasıf olarak anlatıldığı takdirde ise bunun tam tersi olduğu tespit edilmiştir.Çalışmada, iki mezhep arasında tartışılan ve üzerinde anlaşılan illet şartları ele alınmıştır. En sonunda, illet kavramı ve bazı şartlarındeki iki mezhebin farklılıklarının pratik etkisini sundu ve sonuç olarak, iki mezhep arasında birçok fıkhi meselede farklılığa yol açan en önemli temel meselenin, Hanefilerin delilin etkili olmasını şart koşmaları, Şafiilerin ise bunu şart koşmamaları olduğunu tespit etti.

The study aims to explain the impact of the concept of 'illah' and the differences in its conditions between the Hanafi and Shafi'i schools on jurisprudential rulings. By using deductive, inductive, and analytical method, the study has highlighted the points of agreement and disagreement regarding the concept of 'illah' between the two schools, and it concluded that the majority of the two schools of thought agreed on defining the illah with the Identifier, and that the meaning of the illah according to the Hanafi school of thought in terms of describing it as influential, it is broader than its meaning according to the Shafi’is, but in terms of describing it as appropriate, it is the opposite. The study also discussed the disputed conditions of the illah and agreed upon in the two schools of thought, and concluded by stating the practical impact resulting from their difference in the concept of the illeh and some of its conditions, and It concluded that the most important pivotal issue that led to the disagreement between the two schools of thought in many secondary jurisprudential issues is the Hanafi’s requirement that the illah be influential, unlike the Shafi’is, who are satisfied with the suitability of the illah and its suitability to the ruling.
