Türkiye ve Avrupa’da denetimli serbestlik sisteminin yönetim yapısı

Abstract

Toplumlar, yaşadıkları coğrafyaya bağlı olarak farklı sosyo-ekonomik ve kültürel özelliklere sahiptir. Toplumların sahip olduğu bu özellikler ceza, denetimli serbestlik ve sosyal hizmet sistemlerini de doğrudan etkiler. Toplumların bu özellikleri sosyal hizmet politika ve uygulamalarına da yansır ve içinde bulundukları koşullara göre gelişir. Benzer şekilde de hem ceza infaz hem de sosyal hizmet dilemma kuruluşu olan denetimli serbestliğin yönetim yapısı da toplumların özgün şartlarına göre şekillenir. Bu nedenle, her toplumun denetimli serbestlik yönetim yapısı da kendine özgüdür. Denetimli serbestliğin yönetim yapısı bazı ülkelerde kamu iken, bazı ülkelerde özel ya da sivil toplum örgütlenmesi şeklindedir. Yine denetimli serbestlik kamu kuruluşu olan ülkelerin bazılarında Adalet Bakanlığı, bazılarında İçişleri Bakanlığı veya bazılarında Ceza ve Tevkifevleri Genel Müdürlüğü, bazılarında müstakil olarak ilgili Bakanlıkların çatısı altında yapılanmıştır. Bu kapsamda Avrupa ve Türkiye’deki denetimli serbestlik sistemlerinin yönetim yapılarının karşılaştırmalı olarak incelenmesinin sisteme genel olarak katkı sağlayacağı düşünülebilir. Bu çalışmanın konusu, denetimli serbestlik sisteminin Türkiye’de ve Avrupa’daki yönetim yapılarını karşılaştırmalı bir bakış açısıyla ele almak, Türkiye’deki yönetim yapısına ilişkin öneriler sunmaktır.

Societies have different socio-economic and cultural characteristics depending on the geography they live in. These characteristics of societies also directly affect penal, probation and social work systems. These characteristics of societies are also reflected in social work policies and practices and develop according to the conditions they are in. Similarly, the management structure of probation, which is both a penal execution and a social work dilemma institution, is shaped according to the unique conditions of the societies. Therefore, the probation management structure of each society is also unique. While the management structure of probation is public in some countries, it is private or non-governmental organization in some countries. Again, in some countries where probation is a public institution, the Ministry of Justice, the Ministry of the Interior in some, or the General Directorate of Prisons and Detention Houses in some, are structured independently under the roof of the relevant Ministries in some. In this context, it can be thought that a comparative analysis of the management structures of probation systems in Europe and Turkey will contribute to the system in general. The subject of this study is to consider the management structures of the probation system in Turkey and Europe with a comparative perspective, and to offer suggestions regarding the management structure in Turkey.
