667 Fikir ve Sanat Eserleri Üzerindeki Hakların Edinilmiş Mallara Katılma Rejimi Yönünden Değerlendirilmesi

Abstract

Evli kişilerden her biri, gerek evlenmeden önce gerekse evlendikten sonra edinmiş olduğu bir takım taşınır ve taşınmaz mallara sahip olabilir. Keza bunların değeri parayla ölçülebilen sair haklara dasahip olmaları mümkündür. Sözkonusu haklar arasında Fikir ve SanatEserleri Kanunu (FSEK) anlamında eser sayılan fikrî mahsuller üzerindeki telif hakları da olabilir. Hakkın konusunu oluşturan fikrî ürünler, evlenmeden önce meydana getirilmiş olabileceği gibi, evlendiktensonra da meydana getirilmiş olabilir.Eşlerin sahip oldukları eserler üzerindeki malî haklar, eşler arasındaki malî ilişkilerde, diğer malvarlığı değerleri gibi hüküm ve sonuçlara tabidir. Bu makalenin konusunu, fikir ve sanat eserleri üzerindekimalî hakların eşler arasındaki mal rejimleri bakımından değerlendirilmesi oluşturmaktadır. Bu kapsamda, çalışmada evlilik boşanma veyaiptali ya da ölüm gibi sebeplerle sona erdikten sonra, eşlerin sahip olduğu eserler ekonomik haklarına ne olacağı irdelenmektedir. İnceleme yasal mal rejimi olarak kabul edilen edinilmiş mallara katılma rejimineilişkin Medeni Kanun hükümleri ile sınırlandırılmıştır.

Each married person can own various movable and immovable properties that they have acquired both before and after marriage. It is also possible for them to have other rights, the value of which can be measured in money. Such rights may include copyrights on intellectual products considered to be works in the meaning of the Law on Intellectual and Artistic Works. The copyrighted works that constitute the subject of the right may have been produced before marriage or may have been created after marriage. The economic rights on the works of spouses are subject to the same judgment and results with regard to financial relations between spouses such as other assets. The subject of this article is the evaluation of financial rights on intellectual and artistic works in terms of property regimes between spouses in the marriage. In this context, after the marriage ends due to divorce or annulment or death, the works owned by the spouses are examined in terms of their economic rights. The review is limited to the provisions of the Turkish Civil Code regarding the regime of sahring acquired goods accepted as a legal property regime in marriage.
