Yapay Zekâ Çıktılarının Telif Hakları Bağlamında Değerlendirilmesi

Abstract

Yapay zekâ, insan emeğinden ve zamanından tasarruf sağlayarak pek çok alanda verimliliği artırmakta; eğitim, sağlık, adalet ve savunma gibi çeşitli sektörlerde bireysel ve toplumsal yaşamı dönüştürmektedir. Bu teknolojik gelişmeler, hukuk alanında da önemli etkiler doğurmakta ve özellikle fikir ve sanat hukuku bağlamında yeni tartışmaları gündeme getirmektedir. Algılama, öğrenme ve karar verme yetenekleri sayesinde yapay zekâ, insan zekâsı gerektiren görevleri üstlenebilmekte; resim, müzik, metin ve video gibi yaratıcı içerikler üretebilmekte ve bunları farklı formatlara dönüştürebilmektedir. Bu üretim kapasitesi, telif hukuku açısından hem hak ihlali riski hem de eser niteliği taşıyıp taşımama yönünden hukuki belirsizlikler doğurmaktadır. Bu makale, yapay zekâ üretimlerinin telif hukuku kapsamında nasıl değerlendirilmesi gerektiğini ele almakta ve iki temel hukuki sorunu incelemektedir: (1) Yapay zekâ ile üretilen içeriklerin üçüncü kişilerin haklarını ihlal edip etmediği, (2) Bu içeriklerin telif hukuku çerçevesinde “eser” veya “bağlantılı hak konusu” olarak korunup korunamayacağı. Çalışmada öncelikle yapay zekâ üretim sürecinin teknik yönüne değinilmiş; ardından otonom üretim ile insan müdahalesiyle yapılan üretim ayrımı temelinde, çeşitli ülke örnekleri üzerinden pozitif hukuk normları ve yargı kararları ışığında değerlendirmeler yapılmıştır. Son kısımda konu Türk Telif Hukukunun mer’i normları bağlamında incelenmiş ve olması gereken hukuk açısından bazı önerilerde bulunulmuştur.

Artificial intelligence (AI) enhances efficiency across numerous fields by saving human labor and time, and it has profoundly transformed both individual and societal life in sectors such as education, healthcare, justice, and defense. These technological advancements have also begun to exert significant influence on the legal domain, particularly raising new debates within the scope of intellectual property law. With its advanced capabilities in perception, learning, and decision-making, AI can perform tasks traditionally requiring human intelligence. It is capable of producing creative content such as images, music, text, and video, and converting these into various formats. This production capacity gives rise to legal uncertainties, especially regarding the risk of copyright infringement and the qualification of AI-generated outputs as protectable works. This article focuses on how AI-generated outputs should be evaluated within the framework of copyright law and examines two fundamental legal issues: (1) whether AI-generated content infringes upon the rights of third parties, and (2) whether such content can be considered a “work” or a “related rights subject” under copyright protection. The study first outlines the technical aspects of AI’s production process. It then analyzes the legal status of AI outputs based on the distinction between autonomous creation and human-assisted production, referencing examples from various jurisdictions and relevant legal norms and case law. Finally, the issue is assessed within the context of Turkish Copyright Law, and recommendations are offered from the perspective of de lege ferenda.
