İslâm hukukunda meşakkat kavramı ve hükümlere etkisi

Abstract

İslâm dininde mükellefe yüklenen sorumlulukların bütünüyle meşakkatten uzak olması beklenemeyeceği gibi tümüyle meşakkatle yüklü olması da düşünülemez. Çalışmamızda bu noktaya dikkat edilmiş, mükellefin sorumluluk dairesi içerisinde tahammül edilebilir meşakkat ve tahammül edilemeyen meşakkat şeklindeki ayrıma temas ve dikkat çekilmiş, bu meşakkat çeşitlerinden hangisinin şâri' tarafından kaldırılmayı veya hafifletilmeyi murat edildiği belirtilmeye çalışılmıştır. Çalışmamızda meşakkatin kavramsal olarak ihtiva ettiği saha belirlenip, Kur'ân ve Sünnette meşakkatin nasıl ve ne şekilde yer aldığı ortaya konulmuştur. Önceki ümmetlere ve Ümmet-i Muhammed'e yöneltilen hükümlerdeki meşakkatin durumu irdelenmiş, İslâm Hukukunda meşakkatin nasıl tespit edildiği, fukahânın yöntemleri ve görüşleri ile açıklanmıştır. İlâhî hitaplarda bulunan meşakkatin çeşitleri belirtilmiş, meşakkat sebebiyle hükümler üzerinde gerçekleşen ref'ul-harec/zorluğun-meşakkatin kaldırılması ve tahfif konusunun çeşitleri örnekleri ile gösterilmiştir. Meşakkatin kaldırılması veya hafifletilmesini konu alan küllî kâideler izâh edilmiş, bu konuda dinin gâyesinin meşakkat vermemek olduğu naslar ışığındaki örnekler ile sunulmuştur.

In Islam, the responsibilities imposed on the mukallafs are not completely free of hardships (mashaqqāt) nor are they fully hardships. In this study, the distinction between tolerable and intolerable hardship within scope of responsibility has been discussed. Moreover, the study aims to clarify which types of hardships are to be removed or alleviated by sharia. In this study, the conceptual definition of mashaqqa is identified and it has been shown that how mashaqqa takes place in the Qur'an and Sunnah. The situation of the mashaqqa in the decrees ordered to the previous ummahs and the ummah of Muhammad has been examined, and how mashaqqa has been determined in Islamic Law has been explained with the methods and views of the fuqahā. The types of mashaqqā found in the sacred texts have been specified. The subcategories of rafʿ al- kharaj (removal of hardship) and takhfīf (alleviation of hardship) have been elaborated with examples. The legal maxims about the removal or alleviation of mashaqqa have been presented. Lastly, it has been presented with examples from the sacred texts that the aim of religion in this regard is not to cause mashaqqa.
