Hukuk felsefesi açısından stoa okulunda özgürlük anlayışı

Abstract

Çalışmanın amacı, Stoa felsefesinin birey bakımından ele aldığı özgürlük anlayışı ile küresel nitelikteki devlet ve hukuk anlayışının sınırlarını tespit etmek ve birbirinden bağımsız gözüken bu iki anlayışın arasındaki ilişkiyi ortaya koymaktır. Bu araştırma literatür taraması biçiminde yapılmıştır. Literatürde Stoa felsefesinin doğduğu Hellenistik uygarlıktan Roma İmparatorluğuna kadar yapılmış çalışmalar incelenmiş ve çalışma konusunu oluşturan ilişkiye dair düşünceler derlenmiştir. Derlenen düşüncelerden Stoa felsefesinin irade özgürlüğü kavramına determinist bir açıdan yaklaşmasının hukuk düşüncelerine olan nihai etkisi çıkarılmış ve sunulmuştur.

The purpose of this study is to clarify and show the thin correlation between Stoic freedom wich is reviewed under a very personal approach and Stoic conception of universal law and state. This study followed the method of examining the literature of Stoic philosophy from Hellenistic Stoa to Roman Stoa. With that examination, this study gathered all kinds of intellectual material about the conceptions about freedom, law and state for Stoics. Under these conceptions, this study examined the deterministic approach to freedom of will by Stoic philosophers, from the perspective of Stoic philosophy of law.
