Sigorta şirketlerinin doğal afet sigortalarını konu alan reasürans sözleşmelerinde sorumluluğu

Abstract

Çalışmanın amacı sigorta şirketlerinin sermaye yönünden yetersiz kalmaları durumunda taşıdıkları riskleri paylaşmak adına reasürans sözleşmeleri yaptıklarında sorumluluklarının sınırının tespitidir. Çalışmamızda bu sorumluluklar incelenirken doğal afet sigortalarında oluşan sorumluluk sınırı tespiti için özelleştirme yapılmıştır. Çalışma ile mevzuatın anlaşılması ve yorumlanmasına ilişkin tartışmalar yanında uygulamada açığa çıkan ihtilaf noktalarının ortaya konulması ve çözüm önerisinde bulunulması amaçlanmıştır. Sigorta alanı çıkar çatışmalarının en yoğun olduğu sözleşme alanıdır. Bu itibarla hukukun kesinliğe en fazla ihtiyaç duyduğu bir alanı temsil etmektedir. Çalışmamızın söz konusu hukuki kesinliğe katkıda bulunması umulmaktadır. Çalışmamıza güncel Türk Hukuku mevzuatı esas alınmıştır.

The aim of the study is to determine the limit of liability of insurance companies when they make reinsurance contracts to share the risks they carry in case they are insufficient in terms of capital. While these responsibilities were examined in our study, privatization was made to determine the liability limit in natural disaster insurance. The aim of the study is to reveal the points of conflict that arise in practice and to suggest solutions, as well as discussions on the understanding and interpretation of the legislation. The insurance field is the contracting field where conflicts of interest are most intense. In this respect, it represents an area where the law needs certainty the most. It is hopedthat our study will contribute to this legal certainty. Our study is based on current Turkish Law legislation.
