İslam hukuku ve iktisat felsefesinde değer yargısı olarak adalet

Abstract

Tüm iktisadi sistemler; ister seküler içerikli olsun ister dinî içerikli olsun “adalet”i ulaşılması istenen bir değer olarak zikrederler. Bu kavramın içeriği hukuk, iktisat ve siyaset felsefesi zemininde çokça tartışılmıştır. Her sistem bu kavramı kendince tanımladıkları için bu kavramın içeriği, kullanıldıkları alanlarda farklılaşmaktadır. İslam iktisadına dair yazılmış eserlerde “adalet” ve “hakkaniyet” kavramları sıkça kullanıldıkları halde bu kavramların çok da tanımlı olduğunu söylemek mümkün değildir. Biz bu çalışmamızda “adalet” kavramının İslam hukuk ve iktisat felsefesi açısından dinî temeli ve içeriğini analiz etmeye çalışacağız.

Justice is mentioned by all economic systems, secular or religious, as a desirable value. The content of justice has been discussed throughout the contexts of the philosophies of law, economics and politics. There are different contents and definitions of justice, because all of these legal, economic and political systems are focused on justice according to their own scopes. It is not possible to say that “justice” and “equity” are clearly defined, although they are frequently used in the written works of Islamic economics. Hence, in this essay we will analyze the content and the religious base of “justice” in the context of the philosophy of Islamic law and economy
