İslam Ceza Hukukunda diyet ve âkile sistemi

Abstract

Bu çalışmada İslam ceza hukukunda şahıslara karşı işlenen öldürme ve müessir fiiller neticesinde meydana gelen diyet cezası ve İslam'da âkile sistemi her yönüyle işlenilmeye çalışılmıştır. Çalışma iki bölümden oluşmaktadır. Konu birinci bölümde iki temel başlık altında incelenmiş, birinci başlıkta diyetin mahiyeti, tarihçesi, miktarı, hangi mallarla ödendiği, mağdurun cinsiyetinin diyete tesiri, hakimin diyet taktiri ve diyeti düşüren durumlar işlenmiştir. İkinci başlıkta ise azalara karşı işlenen müessir fiiller neticesinde meydana gelen uzvun izalesi veya fonksiyon kaybı ya da yaralanması durumunda ödenmesi gereken diyet miktarları beyan edilmiştir. İkinci bölümde İslam'da âkile sistemi ele alınmış, âkilenin mahiyeti, meşruluğu, tarihi gelişimi, kimlerden oluştuğu ve günümüzde âkile fertlerinin nasıl değerlendirilmesi gerektiği konuları ele alınmıştır.

In this study, the surety system and the diet penalty that being as a resulf of committed battary and assault against individvals try to be processed in islamic Criminal Law. Teh subjeets ove examined under the 2 basic headings. In the first title, the nature, trace end avantity of diet, paid with diet goods which, the influence of the diet of the gender of the rictim, diet the discretion of the juolge, on lowering diet cases try to be procesied. In the second bitle, assault and battery committed against mevabers of that limb ocur as a ressult of improper disposal or oss f function, the amound of diet that needs tobe paid in case of in jures try to be declared. In the second part, the suerty system in İslam taken up, the nature legelity, historical development of surety system and who made of and keep in the surety system membes assesmsnt try to be procossed.
