İslam hukukunda irtidat suçunun düşünce özgürlüğü bağlamında değerlendirilmesi

Abstract

Kaynaklara bakıldığı takdirde irtidat meselesinin mahiyeti hakkında tartışmalar olduğu görülmektedir. Kimi âlimler naslardaki rivayetlerden dolayı mürtedin öldürülmesi gerektiğini savunurken kimi âlimler de düşünce özgürlüğüne aykırı görülmesi sebebiyle karşı çıkmıştır. Bu çalışmada öncelikle irtidadın ceza hukuku sahasına girmesi sebebiyle suç kavramı işlendi. Ardından irtidat kavramı incelenerek, cezasına dair delillerle beraber değerlendirildi. Klasik kaynaklarda irtidada verilen cezanın ne olduğu, o cezanın bugün nasıl anlaşıldığı işlendi. Sonrasında ise düşünce özgürlüğü bağlamında ele alınıp alınamayacağı meselesi tartışıldı. Bu bağlamda da düşünce ve inanç özgürlüğü açısından ayrı ayrı irtidat meselesi ele alındı. Öncelikle irtidada verilen cezanın düşünce özgürlüğü bağlamında değerlendirilmesi yapıldı ardından da İslam'da düşünce özgürlüğü olup olmadığı irdelendi. Bu mesele de önemine binaen İslam Hukuk doktrininde başlığı altında düşünce ve inanç özgürlüğü ayrı ayrı işlendi. Bu meseleler tartışılırken, bu minvalde kaleme alınmış Arapça eserler, makaleler, tercüme eserler kaynak olarak kullanıldı. Genel hatlarıyla verilen tüm kaynakçalar incelendi ve öyle kaynak gösterildi.

When we look at the sources, it is seen that there are discussions about the nature of the apostasy (irtidat) issue. While some scholars argued that the apostate should be killed because of the narrations in the texts, some scholars objected because it was seen as contrary to freedom of thought. In this study, first of all, the concept of crime was discussed, since the concept of apostasy entered the field of criminal law. Then, the concept of apostasy was examined and evaluated together with the evidences regarding its punishment. The nature of the punishment given to apostasy in classical sources and how that punishment is understood today are discussed. Afterwards, the issue of whether it can be handled in the context of freedom of thought was discussed. In this context, the issue of apostasy was discussed separately in terms of freedom of thought and belief. First of all, the punishment given in apostasy was evaluated in the context of freedom of thought, and then it was examined whether there is freedom of thought in Islam. Due to the importance of this issue, freedom of thought and belief was handled separately under the title of Islamic Law Doctrine. While discussing these issues, Arabic studies, articles and translated studies written in this manner were used as sources. All bibliographies given in general terms were examined and cited as such.
