Zâhirü'r-Rivâyede geçen usul konuları

Abstract

Hanefi mezhebinin kurucu imamlarından biri olan Muhammed b. el-Hasen eş-Şeybânî'nin Hanefi mezhebinin teşekkülü ve fıkıh usulünün oluşumunda önemli etkileri vardır. Bu etki en bariz biçimde, Şeybânî'nin telif ettiği, Hanefî mezhebinin kurucu metinleri olarak kabul edilen "zâhirü'r-rivâye" adıyla meşhur olmuş altı eserde görülür. Bu eserler; fıkıh ilminin konu, problem ve dil açısından bağımsız hale geldiğine, fıkhî konuların belirli usul kuralları çerçevesinde şekillendiğine işaret eden, hem müellifin hem de hocaları Ebû Hanîfe ve Ebû Yûsuf'un görüşlerini ihtiva eden Hanefilere ait ilk fıkıh metinleridir. Bu çalışmada sözü edilen fıkhî birikimin dayandığı şer'î deliller çerçevesinde Şeybânî tarafından kaleme alınan bu altı eserin içerisine yayılmış usul konularını istikra yöntemiyle tespit ederek Hanefilerin fıkhî istidlâllerinin temellendirilmesine katkı sağlamaktır. Bununla birlikte ilk dönem Hanefi mezhebinin usûl anlayışının iddia edildiği üzere tamamen fürûdan hareketle tümevarım metoduyla oluşmadığına, ana omurgasının kurucu imamlar tarafından çeşitli fıkhî hükümler içerisine yayıldığı görüşüne katkı sunmaktır. Tezimiz giriş, üç bölüm ve sonuç bölümlerini içermektedir. Giriş bölümünde tezin konusu, amacı, önemi ve özgün değeri, araştırma yöntemi ve "zâhirü'r-rivâye" eserleri üzerine yapılan çalışmalar ele alınmıştır. İkinci bölümde Şeybânî'nin hayatı, dönemin siyasi ve sosyal ortamı, hocaları, öğrencileri, eserleri, Hanefi mezhebindeki yeri ve rolü hakkında bilgiler verilmiştir. Üçüncü bölümde ise önce delil kavramı üzerinde durulmuş, ardından Şeybânî'nin fıkhî çözümlerde başvurduğu Kur'an, sünnet, icmâ, kıyas, sahâbî kavli, istihsan, örf ve şer'u men kablenâ gibi deliller ile yapmış olduğu istidlâller ele alınmıştır. Tez çalışmamızın dördüncü bölümünde usul konularından zâhirü'r-rivâye'de geçen ahkâm ve lafız konuları başlığı altında zâhirü'r-rivâyede hüküm konusu, lafza ait usûl kuralları ve hüküm çıkarma yolları ortaya konulmaya gayret edilmiştir. Teklifî ve vazʻî hükümler kavramsal çerçeveleriyle birlikte ele alınmış, daha sonra zâhirü'r-rivâyede geçen teklîfî ve vazʻî hükümler kullanım çeşitleriyle tespit edilmeye çalışılmıştır. Hüküm konusuyla yakın bağlantısına binaen naslardan hüküm çıkarma yolları konusu da bu başlık altında incelenmiştir. Yine fıkıh usulünün önemli konularından olan ehliyet ârızaları, teâruz, tercih ve nesih konularına da hüküm konusuyla yakın bağlantısına binaen bu bölümde yer verilmiştir. Ayrıca çalışmamız kapsamında ulaşılan sonuçların, Hanefî mezhebinin usûl ve fürû' kaynaklarındaki bilgilerle de mukayesesi yapılmaya çalışılmıştır. Sonuç kısmında ise elde edilen bulguların Hanefî mezhebi fıkıh külliyatına katkısı hususu değerlendirilmiştir.Muhammad b. al-Hasan al-Shaybani is one of the constituents of the Hanafi sect in the 2nd year of emigration who has a great impact on the formation of usul al-fiqh of the Hanafi sect. We can see this impact most sharply in his six books known as "Zahir-al-Riwayah" which are acknowledged as the constituent scripts of the Hanafi sect. These are the very first books which show the separation of Fiqh by its topics, problems and language and show that the topics of Fiqh are formed in certain jurisprudential methods. These books can be acknowledged as the very first examples in the history of Fiqh which contain the arguments of the author's teachers Imam Abu Hanifah and Abu Yusuf alongside his arguments and were unopened for others' compendium. This study aims to contribute to grounding the deductions of Fiqh according to the spiritual circumstances by finding the problems and topics of Usul-al-Fiqh which are spread in "Zahir-al-Riwayah". Hereby, this study promotes the stance that the skeleton of Usul-al-Fiqh of the Hanafi sect is made with the arguments of their constituents and not with the inductive method beginning from descendants as professed. This thesis consists of an introduction, three main chapters and a conclusion chapter. The introduction discusses the topic of the thesis and its aim, the importance of the thesis and its original value, the method of the study and the works done on Zahir al-Riwayah. The second chapter touches on the life of Imam Muhammad, the political and social life of his era, his teachers, his students, his books, and his role and position in the Hanefi sect. The third chapter firstly deals with the concept of "reason", then it discusses the reasons referred to by Imam Muhammad in solving the jurisprudential problems such as the Qur`an, sunnah, consensus and analogy, sayings of companions, juristic preference, common law and the revealed law preceding the shari`ah. The fourth chapter with its heading "The Jurisprudential Topics and Words in Zahir-al-Riwayah" deals with judgment, jurisprudential rules regarding a word and how to reveal the rule in Zahir-al-Riwayah. While explaining judgment, firstly al-hukm al-taklifi and al-hukm al-wad`i are specified within their concept. After that, this study tries to determine the al-hukm al-taklifi and al-hukm al-wad`i with their different usage in Zahir al-Riwayah with the induction method. Because of having a strong connection with judgment, revealing the judgment from texts` (al-istinbat) topic is also processed under this heading as a textual topic. The important usul al-fiqh topics which have a strong connection with al-hukm such as abrogation, merit breakdowns, conflict and preference are also studied under this heading. In addition, this study takes into consideration if the conclusion of the thesis corresponds with the data of Hanafi fiqh`s sources. The conclusion points out the contribution of the results obtained to the Hanafi madhab`s fiqh culture.
