Türkiye’de Tutuklu ve Hükümlü Haklarına Genel Bakış

Abstract

Suç ve suçluluk olgusu, yalnızca suç işleyen bireylerle sınırlı kalmayıp toplumsal düzeyde geniş çaplı etkiler yaratmaktadır. Suçun nedenleri ve sonuçları, bireysel düzeyin ötesine geçerek toplumsal yapıyı, ekonomik dengeleri ve psikolojik sağlığı etkilemektedir. Bu bağlamda, suçun azaltılması ve suç işlemeyi engelleme çabalarında adli sosyal hizmetlerin rolü kritik bir önem taşımaktadır. Adli sosyal hizmet, suç işlemiş ya da suça sürüklenmiş bireylerin rehabilitasyonu ve topluma yeniden entegrasyon süreçlerinde aktif bir rol oynayarak toplumsal refahı artırmayı hedeflemektedir. Bu sürecin önemli bir bileşeni de tutuklu ve hükümlü bireylerin haklarının korunmasıdır. Tutukluluk ve hükümlülük hali, bireylerin özgürlüklerini kısıtlayarak çeşitli hak ihlallerine açık bir durum yaratmaktadır. Bu nedenle, ulusal ve uluslararası hukuk normları bu bireylerin haklarını koruma amacı taşımaktadır. Adli sosyal hizmet kapsamında ele alınan bu derleme çalışmada, suçla mücadelede toplumsal yaklaşımların önemi vurgulanmakta ve adaletin sağlanması için adil çözümlerin gerekliliğine dikkat çekilmektedir. Adalet sisteminin ve sosyal hizmetlerin suçla mücadeledeki rolünün genişletilmesi, daha adil ve etkili çözümler üretilmesi gerektiğini ortaya konmaktadır. Bu bağlamda, adli sosyal hizmetlerin kapsamlı bir şekilde ele alınması ve güçlendirilmesi hem suça konu bireylerin hem de toplumun genel refahını artırmak için gerekli bir adım olarak görülmektedir. Sonuç olarak, tutuklu ve hükümlü haklarının korunması, adalet sisteminin temel bir parçasıdır. İnsan hakları normlarına uygunluk, yalnızca bireylerin haklarını değil, aynı zamanda toplumsal adaletin sağlanmasını da güvence altına almaktadır.

The phenomenon of crime and criminality is not limited to individuals who commit crimes but has far-reaching effects at the societal level. The causes and consequences of crime go beyond the individual level and affect the social structure, economic balances, and psychological health. In this context, the role of forensic social services is critical in efforts to reduce crime and prevent crime. Forensic social work aims to increase social welfare by playing an active role in the rehabilitation and reintegration processes of individuals who have committed crimes or have been dragged into crime. An important component of this process is the protection of the rights of arrested and convicted individuals. The state of detention and conviction restricts the freedoms of individuals and creates a situation open to various violations of rights. Therefore, national, and international legal norms aim to protect the rights of these individuals. In this review study, which is addressed within the scope of forensic social work, the importance of social approaches in the fight against crime is emphasized and the necessity of fair solutions to ensure justice is highlighted. It is revealed that the role of the justice system and social services in the fight against crime should be expanded and more fair and effective solutions should be produced. In this context, a comprehensive approach and strengthening of forensic social services is seen as a necessary step to improve the overall well-being of both individuals subject to crime and society. In conclusion, the protection of the rights of detainees and prisoners is a fundamental part of the justice system. Compliance with human rights norms guarantees not only the rights of individuals but also the provision of social justice.
