Sendika genel kurul kararlarının hukuki niteliği ve buna bağlı sonuçlar

Abstract

Sendikanın en üst karar organı genel kuruldur. Bütün genel kurul kararlarında olduğu gibi sendika genel kurulunda alınan kararlar birer hukuki işlemdir. Genel kurul kararının hukuki niteliği ve bu hukuki niteliğe bağlı olarak ortaya çıkan sonucun hüküm doğurma anı çalışmada tartışılmaktadır. Ayrıca genel kurul kararlarının türleri incelenmektedir. Çalışmada özellikle esasa ve usule ilişkin kararlar, seçim kararları, üçüncü kişiye bildirilmesi gerekli kararlar, yenilik doğuran kararlar ve tespit kararları üzerinde durulmaktadır. Sendika genel kurulunun vekalet kararlarında düzen ilkesi getirilmesi görüşü sunulmaktadır. Farklı kararların farklı hukuki niteliği haiz olmaları, hüküm doğurdukları anı ve etkilerinin süresini değiştirmektedir. Bu nedenle sendika genel kurul kararlarının hukuki niteliklerini tartışmanın önemi sadece teoride değil, uygulamada da görülmektedir.The top decision making body of the union is the general assembly. As all general assembly resolutions, decisions taken at the union general assembly are legal transaction. The legal nature of the decision of the general assembly and the moment of judgment of the outcome resulting from this legal nature are discussed in the study. In addition, the types of general assembly resolutions are examined. In the study, especially the decisions regarding the principles and procedures, the election decisions, the decisions to be notified to the third party, the formative decisions and the determination decisions are emphasized. Opinions are offered to introduce a principle of order in the proxy decisions of the union general assembly. The fact that different decisions have different legal characters changes the moment of their effect and the duration of their effects. Therefore, the importance of discussing the legal characters of union general assembly decisions is not only seen in theory, but also in practice.
