The researcher followed a group of scientific methodologies which theme, through the descriptive approach, the researcher on the basis of contracts and companies in Islamic jurisprudence, based on the Holy Quran; because it is the source of the provisions, and the sunna of the prophet and annotations, and opinion juries contemporary companies, to addressing the inherent ideas and opinions that have tried to identify the concepts of contemporary companies in Islamic jurisprudence, and comparison between companies in Islamic jurisprudence, and companies in the positive economy, in order to stand on some of the implications that require stand, reflected the benefit of the study, an effort possible tried to show all the theme of what the Islam of balance and moderation.
