Abstract

The research aims to shed light on the contemporary companies contracts and their provisions and their applications, and awareness of the extent to which they conform to the criteria of legitimacy, as well as knowledge of the theories of contracts in Islamic jurisprudence and the secular laws and drafted contracts in Islamic jurisprudence, and the role that achieved by companies in Islamic jurisprudence, as well as know the basis for the general provisions of contemporary companies, and then propose a set of solutions that enable companies to contribute to the advancement of contemporary Islamic economy. The researcher followed a group of scientific methodologies which theme, through the descriptive approach, the researcher on the basis of contracts and companies in Islamic jurisprudence, based on the Holy Quran; because it is the source of the provisions, and the sunna of the prophet and annotations, and opinion juries contemporary companies, to addressing the inherent ideas and opinions that have tried to identify the concepts of contemporary companies in Islamic jurisprudence, and comparison between companies in Islamic jurisprudence, and companies in the positive economy, in order to stand on some of the implications that require stand, reflected the benefit of the study, an effort possible tried to show all the theme of what the Islam of balance and moderation.
