Konut Dokunulmazlığını İhlal Suçu

Abstract

Konut dokunulmazlığı hakkı; kişilerin konutunda, işyerinde veya bunların eklentisindeyken hürriyetlerine, huzur ve sükûnlarına yönelik saldırıya karşı koruma sağlamaktadır. Konut dokunulmazlığı hakkı; hak sahibine, rızası dâhilinde konutuna kimin gireceği ve hak sahibi konuta girilmesine başlangıçta rıza vermiş olsa dahi bu yerde kimin kalmaya devam edeceği hususunda seçim özgürlüğü sağlamaktadır. Doğal olarak hak sahibinin rıza göstermediği kişiler açısından ise konuta müdahalelere karşı hak sahibine bu eylemleri men etme hakkı tanımaktadır. Konut dokunulmazlığını ihlal suçu; hak sahibinin konutuna, işyerine veya bu yerlerin eklentilerine girilmesini konu edinmektedir. Konut, işyeri veya bunların eklentileri niteliğinde olmayan yerlerde konut dokunulmazlığını ihlal suçu oluşmayacağından bir yerin konut, işyeri veya bu yerlerin eklentisi niteliğinde olup olmadığı önem arz etmektedir. Bu nedenle belirtilen kavramlar konut dokunulmazlığını ihlal kapsamında açıklandıktan sonra konut dokunulmazlığını ihlal suçu incelenmeye çalışılacaktır. Çalışmamız dört bölümden oluşmaktadır. Birinci bölümde, konut dokunulmazlığı hakkının tarihsel gelişimi ele alındıktan sonra ikinci bölümde, konut dokunulmazlığını ihlal suçunun 765 sayılı mülga Türk Ceza Kanunu'nda düzenlenişi, suçta korunan hukuksal yarar, suçun unsurları, hukuka uygunluk nedenleri, kusurluluk ve kusurluluğu etkileyen nedenler incelenmektedir. Üçüncü bölümde suçun özel görünüş halleri incelenmiş olup; son olarak dördüncü bölümde kovuşturma başlığı altında, konut dokunulmazlığını ihlal suçunda görevli ve yetkili mahkeme, zamanaşımı, suça karşılık öngörülen yaptırım, soruşturma ve kovuşturma usulü incelenmektedir.

The Right to Inviolability of Residence protects individuals freedom, peace and tranquility from unlawful interference in their homes, workplaces, or their appurtenances. This right grants the holder the liberty to determine who may enter their residence and even if prior consent is given, who may continue to remain there. Naturally it also provides the right holder with the authority to prevent actions by individuals who do not have their consent. The offense of violating the inviolability of residence pertains to unauthorized entry into a residence, workplace or their appurtenances. Since the offense does not apply to places that do not qualify as a residence, workplace or appurtenance determining whether a particular location falls under these categories becomes crucial. For this reason the relevant concepts will be explained within the scope of the inviolability of residence followed by an examination of the offense. This study consists of four sections. In the first section, the historical development of the right to inviolability of residence is discussed. The second section examines the regulation of the offense of violating the inviolability of residence under the repealed Turkish penal code no 765, including the legal interest protected by the offense, its elements justifications, culpability, and factors affecting culpability. The third section analyzes the specific forms of the offense. Finally, in the fourth section under the title of prosecution, topics such as the competent and authorized court for the offense, statutes of limitation, the prescribed sanctions, and the procedure for investigation and prosecution are addressed.
