Bugünümüz Sukuk Uygulamalarının İslam Fıkhı ve İktisadı Açısından Tahlili

Abstract

İslam’ın iktisadî hayata ilişkin ilkelerinden başta geleni faizsizliktir. Bu ilke erken dönemden itibaren Müslümanları faizsiz finansal ürünler geliştirmeye ve bunları uygulayacak kurumları tesise sevk etmiştir. XX. yüzyılın son çeyreğinde bu çerçevede dünyada çok sayıda yeni finansal ürün geliştirildi. Son yıllarda Türkiye de bu sürece katıldı; İslamî olduğu düşüncesiyle çok sayıda finansal ürünü piyasaya sürdü. Alternatif nitelikli sermaye piyasası araçlarının başında önceleri Mudâraba (Mukâraza), Müşâreke ve İcare sertifikaları gelirken günümüzün revaçtaki ürünü Sukuk’tur. Ülkemizde sukuk yerine, aynı anlamı ifade etmek üzere Kira Sertifikası (KS) tabiri kullanılmaktadır. Türkiye’de Cumhuriyet sonrasında faizsiz olduğu düşüncesiyle piyasaya sürülen ilk sermaye piyasası aracı DESİYAB ortaklık sertifikalarıdır (DOS). Daha sonra Gelir Ortaklığı Senetleri (GOS), Kâr ve Zarar Ortaklığı Belgeleri (KOB), Gelire Endeksli Senetler (GES) ihraç edildi ve son olarak Kira Sertifikaları (KS) piyasaya arz edildi. Dolayısıyla sukuk -Türkiye’deki adıyla KS- teorik düzeyde de olsa, tarihi süreçte risk ve menfaat paylaşımına dayalı olarak ihraç edilmiş her biri diğerinden bağımsız faizsiz finansal ürünlerin hemen tüm özeliklerini içinde barındıran paket ürün olarak tasarlanıp teklif edilmiştir. Biz bu metinde sukuk’u tanımı, ortaya çıkışı, temel unsurları ve fıkhî durumu açısından ele alacağız.

The most important principle of Islam regarding economic life is interest-free. This principle has driven Muslims to develop interest-free financial products and establish institutions to implement them since the early period. In the last quarter of the 20th century, many new financial products were developed in the world within this framework. In recent years, Turkey has also joined this process; it has launched many financial products on the market with the idea that they are Islamic. While the Mudaraba (Muqaraza), Musharakah and Ijarah certificates were at the forefront of alternative qualified capital market instruments, today’s popular product is Sukuk. In our country, instead of Sukuk, the term Lease Certificate (KS) is used to express the same meaning. The first capital market instrument launched on the market with the idea that it is interest-free after the Republic of Turkey was the DESIYAB partnership certificates (DOS). Later, Revenue Sharing Notes (GOS), Profit and Loss Sharing Certificates (PSC), Revenue Indexed Notes (RES) were issued and finally Lease Certificates (RS) were offered to the market. Therefore, sukuk - as it is called in Turkey - has been designed and offered as a package product that includes almost all the features of interest-free financial products, each independent from the other, issued based on risk and benefit sharing in the historical process, albeit theoretically. In this text, we will discuss sukuk in terms of its definition, emergence, basic elements and jurisprudential status.
